Regulation on the Order of Payment, Receipt, and Exchange of Gift Certificates in iSpace Retail Chain

1. GENERAL PROVISIONS

1.1. A Gift Certificate (hereinafter – “Certificate”) is a document confirming the right of its holder to purchase goods or services in iSpace retail chain of ASBC LLC (hereinafter – the “Company”) for an amount equal to the face value of the Certificate.

The Certificate contains an individual number, the date of purchase, and a specified face value.


The Purchaser of the Certificate is an individual or legal entity that has paid monetary funds equal to the face value of the Certificate in lieu of goods sold at the place of sale of the Certificate and has transferred to a third-party individual, for whose benefit the Certificate was purchased, the right to receive goods by exchanging the Certificate to goods.


The Holder of the Gift Certificate is an individual who has temporarily received the Gift Certificate and presents it for redemption.


1.2. The rules for payment, receipt, and exchange of Certificates are regulated by this Regulation.


1.3. The Gift Certificate is not personalized. The Purchaser of the Certificate has the right to gift or otherwise transfer the Certificate to a third party. The Company bears no responsibility for to whom and on what grounds the Certificate is transferred by the Purchaser or any third party.


1.4. The Gift Certificate constitutes a public offer. These rules define the essential terms of a public sales contract using Certificates.

Upon sale of the Certificate, the Purchaser is informed of the rules for handling Certificates as set out in this Regulation. Purchasing a Certificate constitutes the Purchaser’s agreement to this Regulation.


1.5. This Regulation is freely available on the website https://ispace.az and is also available in the sales areas of the “iSpace” stores at the following addresses:

1.6. The Company reserves the right, at its discretion, to make changes to this Regulation.

2. PROCEDURE FOR PURCHASING A GIFT CERTIFICATE

2.1. Certificates are purchased for a fee, using cash and/or non-cash payment, and are used to buy goods available at the Company at the time the Certificate is presented, or services.


2.2. The Purchaser of the Certificate pays the Company an amount of money equal to the face value of the Certificate, either in cash or by transferring funds to the Company’s bank account as non-cash payment for the Certificates.

2.3. The face value of the Certificate confirms the right of the holder of that Certificate to receive goods in the amount indicated on the Certificate.


2.4. The face value of the Certificate is indicated on the Certificate.

2.6. When a Certificate is sold to an individual, a fiscal receipt is issued to ensure proper inventory accounting and consumer rights protection. When sold to a legal entity, an act of transfer and acceptance of the Certificate and a fiscal receipt, if payment is made in cash.


2.7. The Certificate is activated on the day of its sale and is valid for 12 (twelve) months from the date of purchase, unless otherwise specified on the Certificate itself.


2.8. The validity period of the Certificate cannot be extended.


2.9. Discounts do not apply to the purchase of a Gift Certificate.


2.10. If the Certificate is lost/stolen/damaged, it cannot be restored, and the money paid for it is non-refundable.


2.11. The Certificate cannot be exchanged or returned, as it is not subject to provisions of the Law of the Republic of Azerbaijan On Protection of Consumer Rights dated September 19, 1995, No. 1113.


2.12. If the Certificate is not used within its validity period, the money paid for it is non-refundable. Any remaining balance on the Certificate will not be returned.


2.13. The Company may refuse to redeem the Certificate if:

2.13.1. The Holder of Certificate did not present the Certificate for payment of the Company’s services or presented another document containing signs of forgery of the Certificate;

2.13.2. The Holder of Certificate presents a Certificate with an expired validity period;

2.13.3. The Holder of Certificate presents a Certificate damaged to the extent that its number, face value, and security features cannot be read;

2.13.4. The Holder of Certificate presents a Certificate that has already been used.

3. REDEMPTION OF THE GIFT CERTIFICATE

3.1. Certificates are accepted for redemption in all “iSpace” retail stores. In accordance with this Regulation, the Company undertakes to provide goods available at the time the Certificate is presented to any person who presents the Certificate, regardless of the identity of the presenter (the Holder of Certificate) or the grounds on which the presenter obtained the Certificate, under the following conditions:

  • Certificate may be presented by an adult with legal capacity;
  • Certificate may be presented by a minor only together with a parent (legal representative).


3.2. The entire face value of the Certificate must be used at once and in full when purchasing goods.


3.4. Funds are credited to the Certificate only once — at the time of purchase.


3.5. The Holder of Certificate should keep the fiscal receipt for the purchase of the Certificate to take into account potential deterioration of the Certificate.


3.6. When exchanging Certificates for goods (works, services), three situations are possible:

  • The cost of the goods (works, services) is equal to the face value of the Certificate;
  • The cost of the goods (works, services) exceeds the face value of the Certificate;
  • The cost of the goods (works, services) is less than the face value of the Certificate.


3.7. If the total cost of selected goods exceeds the face value indicated on the Certificate, the difference must be paid by the Holder of Certificate in cash at the Company’s cash desk and/or by non-cash payment.


3.8. If the total cost of selected goods (works, services) is less than the face value of the Certificate, the remaining difference is not refunded to the Holder Certificate.


3.9. Payment by Certificate is allowed for goods participating in the Company's promotion campaigns. However, the Company has the right to restrict applications of discounts to goods participating in promotion campaigns when such Goods are purchased using Certificates.


3.10. Wallet bonus points are not accrued to the purchaser of the Certificate.


3.11. It is permitted to combine several Certificates to make a single purchase.


3.12. Damaged Certificates or Certificates the authenticity of which is doubted by the Company’s staff are not accepted for redemption.

4. ADDITIONAL CONDITIONS

4.1. Warranty service, exchange, and return of defective goods, as well as goods of improper quality purchased using the Certificate, are carried out in the general manner prescribed by the current legislation of the Republic of Azerbaijan. Exchange of defective goods or goods of improper quality is carried out only for an identical item. Exchange to monetary funds is not permitted.


4.2. The Company reserves the right to make any changes to this Regulation at any time and unilaterally. Information about changes to the terms is posted on the Company's website and is publicly accessible. The Holder of Certificate must independently monitor updates to the rules governing the use of Certificates.


4.3. The Company is not responsible for unauthorized use of the Certificate, since it is a bearer instrument and does not require identity verification.


4.4. The Company is released from liability in the event of force majeure circumstances that make redemption of a Certificate impossible.
